Terms of service

These terms cover legato.fm, the optional legato.fm account, and the Legato remote-access service. "We" and "us" mean Daniel Churchill. By creating an account or using the service, you agree to them. If you don't agree, don't use them. The privacy policy explains what we collect and why.
Legato is pre-release
Legato is still being built. Features will change, some will break, and some may be removed. We'll try to give notice before anything you rely on goes away, but during the beta we can't promise the service will always be available or that it won't change.
The software you run yourself
The Legato desktop app and server run on your own hardware, and these terms don't give us any say over what you do with them there. The software comes with its own licence: included with the download.
Your account
- An account is for one person. Keep your sign-in secure, and tell us if you think someone else has used it.
- You're responsible for what happens through your account and the servers you link to it.
- You can stop using legato.fm and delete your account at any time. Email [email protected] until self-service deletion arrives.
Your music
Your music and everything you do with it stays yours. We don't claim any rights to it, and the remote-access service only passes it between your own devices and your own server. Use Legato with music you have the right to play. If you give other people access to your server, follow the law where you live on sharing music, and keep it to people you know.
Fair use of the service
Don't use legato.fm or the remote-access service to:
- distribute music or other material to the public, or share anything you don't have the right to share;
- break the law, or help someone else do so;
- get into accounts or servers that aren't yours, or probe, scan, or attack our systems;
- put a load on the service far beyond normal personal use, or resell access to it.
If an account breaks these rules, we may suspend or close it. Where we reasonably can, we'll tell you first and give you a chance to fix the problem.
Other services
Signing in with Google or GitHub, and the music databases your server looks things up in, are run by other companies under their own terms. We're not responsible for them.
Paid remote access
Remote access will be a paid subscription when it launches. Before you pay, you'll see its price and what happens when you cancel: your servers keep working at home, and remote access stops at the end of the period you've paid for. Payments will be taken by a separate payment provider, whose terms will also apply at checkout.
No warranty
We build Legato carefully, but it's provided "as is". We don't promise it will be error-free, always available, or right for your purpose. Keep your own backups of your music. Legato reads your files, and can write tags back to them when you ask it to.
Limit of liability
As far as the law allows, we're not liable for indirect or consequential losses, or for lost data or profits, arising from your use of legato.fm or the remote-access service. Our total liability to you is limited to what you've paid us in the 12 months before the claim, or $50 if you've paid nothing. Nothing in these terms takes away rights you have under consumer protection law that can't be waived.
Ending things
You can stop at any time. We may end the service, or your account under the fair-use rules above. If we shut down legato.fm accounts or remote access entirely, we'll give at least 30 days' notice by email, and Legato will keep working on your own hardware.
Changes to these terms
When we change these terms, we'll update the date at the top. If a change matters to how you use Legato, we'll email account holders before it takes effect. Continuing to use the service after that means you accept the new terms.
The law that applies
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. That doesn't take away consumer protections that apply where you live.
